Service Agreement

By accessing and using BehaviorWorks platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. Our behavior analytics platform is provided to qualified game development professionals and studios.

These terms govern your use of our SDK, analytics dashboard, pattern library, and all related services provided through the BehaviorWorks platform.

Account Registration and Eligibility

You must be at least 18 years old and represent a legitimate game development entity to create an account. All registration information must be accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

Subscription Plans and Billing

BehaviorWorks offers various subscription tiers with different feature sets and usage limits. Subscription fees are billed in advance on a monthly or annual basis as selected during signup.

All fees are non-refundable except as expressly stated in our refund policy. Price changes will be communicated with 30 days advance notice for existing subscribers.

SDK Integration and Data Collection

Our SDK must be integrated according to provided documentation and best practices. You are responsible for ensuring proper implementation and compliance with applicable privacy laws in your jurisdiction.

You warrant that you have obtained necessary consents for data collection and that your use of our SDK complies with your game's privacy policy and applicable regulations.

Acceptable Use Policy

You may not use our platform for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include attempting to gain unauthorized access, reverse engineering, or interfering with other users.

You agree not to use our services to collect data from minors without appropriate parental consent or to implement manipulative or harmful game mechanics that exploit vulnerable players.

Intellectual Property Rights

BehaviorWorks retains all rights to our platform, SDK, analytics tools, and proprietary algorithms. You receive a limited, non-exclusive license to use our services according to your subscription plan.

You retain ownership of your game data and content, while granting us necessary rights to process and analyze this data to provide our services and improve our platform.

Data Ownership and Usage Rights

You maintain ownership of all game data and player information collected through our SDK. We process this data solely to provide analytics services and generate insights as specified in your service agreement.

Aggregated and anonymized insights may be used to improve our pattern library and research initiatives, always ensuring individual privacy and competitive confidentiality.

Service Availability and Support

We strive to maintain high service availability but cannot guarantee uninterrupted access. Scheduled maintenance will be announced in advance, and we provide status updates during any service disruptions.

Support is provided according to your subscription tier, with response times and support channels clearly defined in your service level agreement.

Limitation of Liability

BehaviorWorks' liability is limited to the amount paid for services in the twelve months preceding any claim. We are not liable for indirect, incidental, or consequential damages arising from service use.

Our platform provides analytical insights and recommendations, but final game design decisions and their outcomes remain your responsibility.

Termination and Account Closure

Either party may terminate the service agreement with appropriate notice as specified in your subscription terms. We may suspend or terminate accounts for violations of these terms or non-payment.

Upon termination, you retain access to your data for a specified period to facilitate export, after which data will be securely deleted according to our retention policy.

Indemnification

You agree to indemnify and hold BehaviorWorks harmless from any claims arising from your use of our services, violation of these terms, or infringement of third-party rights.

This includes costs and damages related to improper data collection, privacy violations, or misuse of our analytics insights in your game development process.

Governing Law and Dispute Resolution

These terms are governed by Brazilian law, with disputes subject to the jurisdiction of Rio de Janeiro courts. We encourage resolution through direct communication before pursuing formal legal action.

For international clients, we may agree to alternative dispute resolution mechanisms appropriate to your jurisdiction and the nature of the disagreement.

Changes to Terms

We may modify these terms to reflect changes in our services, legal requirements, or business practices. Significant changes will be communicated with 30 days advance notice.

Continued use of our services after term modifications constitutes acceptance of the updated agreement. If you disagree with changes, you may terminate your subscription.
